Prison for man caught drinking alcohol on Scarborough streets

Breaching a Criminal Behaviour Order has resulted in David Fraser Flinton being sentenced to 12 months in prison.

Flinton, 45, of Spreight Lane Steps in Scarborough was previously made the subject of a Criminal Behaviour Order on 9 December 2025, when he was restricted from being in possession of an open container of alcohol or consuming alcohol in a public place in a defined area of Scarborough.

When he appeared before Scarborough Magistrates Court on Monday, (12 October 2026) Flinton pleaded guilty to five breaches of the order and one offence of trespassing on a railway.

As Flinton was sentenced, the court noted a flagrant disregard for court orders, adding that there was no real prospect of rehabilitation as there was a wilful refusal to comply with orders.

Flinton was also ordered to pay a victim surcharge of £187.00.
