A householder who refused to remove dog poo and rubbish from a shared garden faces a £2,491 bill.

Sam Paton shares a back garden in Arran Place with his neighbour, York magistrates heard.

Victoria Kirk, for City of York Council, said its officers counted 100 dog faeces in Paton’s part of the garden on January 6 and when they returned on January 13 they also found bicycle tyres, wood and felt.

The neighbour couldn’t use the garden without climbing over the rubbish, she said.

Paton did not comply with two council orders setting deadlines for him to clear his part of the garden.

Paton, 24, of Arran Place, Heworth, did not respond to the court summons and did not attend court.

Magistrates convicted him in his absence of failure to comply with a community protection notice between February 23 and June 5.

They fined him £660 and ordered him to pay a £264 statutory charge and £1,567 prosecution costs.
